In 1978, the Arizona State Legislature passed mandatory sentencing Laws, essentially requiring mandatory prison sentences for all felons convicted of a subsequent felony, first time felons guilty of certain dangerous crimes and certain sex crimes against children. While courts now follow presumptive sentencing guidelines, a prison sentence can be reduced or mitigated by demonstrating facts or circumstances that warrant a reduction in the sentence. Conversely, the prosecutor can ask for an aggravated sentence if certain aggravating circumstances are shown.
